Terms of Service

These Terms of Service govern your use of DreamDive, VideoExpander, and ImagineMe, including shared accounts, custom models, jobs, image and video generations, APIs, subscriptions, and related services.

Terms of Service Privacy Policy Cookie Use

1. Introduction

These Terms of Service (the “Terms”) form a binding agreement between you (“you” or “User”) and Latysocles Studio (“DreamDive”, “VideoExpander”, “ImagineMe”, “we”, “our” or “us”). They govern your access to and use of DreamDive, VideoExpander, ImagineMe, dreamdive.ai, videoexpander.ai, imagineme.ai, our shared account system, websites, applications, APIs, dashboards, media generation tools, subscriptions, and related services, and any other product or service that links to or references these Terms (collectively, the “Service”).

DreamDive, VideoExpander, and ImagineMe use a shared account system. A single account may be used across all three products, and account registration, authentication, billing/subscription status, security controls, account settings, account deletion, and abuse-prevention measures may apply across the Service.

Acceptance mechanics. By registering for an account, accessing or using the Service, or clicking “I agree” (or similar), you confirm that you have read, understand, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

The Service uses generative AI and other experimental technologies. Outputs can be unpredictable, may contain errors or bias, may resemble existing works, and may not be suitable for every use. You are solely responsible for how you use the Service and any outputs generated through it.

These Terms incorporate by reference any policies we make available in the Service, including our Privacy Policy, our Cookie Policy, and any additional safety, content, or usage policies we link to from the Service (collectively, “Policies”). If these Terms conflict with a Policy, these Terms control unless the Policy expressly states otherwise.

These Terms do not constitute legal advice to you. We strongly recommend that you seek your own legal counsel if you are unsure how these Terms apply in your jurisdiction or to your particular use case.

2. Eligibility and Accounts

2.1 Age and capacity. You may only use the Service if you are at least the age of majority in your place of residence and have the legal capacity to enter into a binding contract. The Service is not intended for, and must not be used by, children under 13 years old, or any higher minimum age required by applicable law.

2.2 Account registration. To use certain features (for example, subscriptions, training characters or custom models, generating images or video, or using the API), you must create an account and provide accurate, complete, and current information. You are responsible for keeping your account information up to date.

2.3 Account security. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account, whether or not authorized by you. You agree to: (a) immediately notify us of any suspected or actual unauthorized use of your account or security breach; and (b) take reasonable steps to secure your devices and credentials.

2.3(a) Account compromise response. To protect you and the Service, we may take reasonable steps if we suspect credential stuffing, account compromise, or abusive access patterns, including resetting sessions, requiring a password reset, applying rate limits, or temporarily suspending access. To the maximum extent permitted by law, we are not responsible for losses caused by compromised credentials outside our reasonable control.

2.4 No account sharing. You must not share your account credentials with anyone else or allow another person to access the Service via your credentials, except as explicitly permitted in writing by us.

2.4(a) Shared product account. Your account is a shared account for DreamDive, VideoExpander, and ImagineMe. Actions taken under your account on one product may affect your access, account state, subscription state, quotas, security status, settings, or deletion state across the Service.

2.5 Single user responsibility. You are fully responsible for all acts or omissions of any person who accesses the Service under your account. All such use will be deemed your use for purposes of these Terms.

3. Description of the Service

3.1 Overview. DreamDive, VideoExpander, and ImagineMe provide tools and infrastructure to:

  • create and manage characters and custom models, including training custom models on your data;
  • submit jobs for image generation (TXT2IMG, inpainting, etc.), masking, and video generation;
  • store and deliver generated media via cloud storage and content delivery networks; and
  • access programmatic APIs and dashboards for managing your content and usage.

3.2 Third-party infrastructure and subprocessors; external AI processing. We rely on third-party providers (for example, cloud hosting, databases, CDNs, AI model providers, analytics, and payment processors) to deliver the Service. Your prompts, uploads, model-training data, and Outputs may be transmitted to and processed by these providers as reasonably necessary to provide the Service (including running jobs you request).

These third parties may be subject to their own terms and policies. We use reasonable measures to select vendors and to impose contractual restrictions where appropriate, but we are not responsible for a vendor’s independent retention or use of data except to the extent we have contractually restricted it and as required by law. Where appropriate, we require subprocessors to process personal data only on our instructions under contractual protections (for example, data processing addenda), and we use transfer safeguards where required. You accept the dependency risk of these providers, and we are not responsible for their outages, interruptions, or acts or omissions, except to the extent required by applicable law.

3.3 No guarantee of results. We do not promise or guarantee any specific type, quality, or accuracy of outputs, uptime, speed, or performance. The Service, including all AI features, is provided “as is” and “as available” (see Section 13).

3.4 Regional availability. Some features, subscriptions, or functionality may not be available in all countries or regions, and we may restrict access to certain features where required for legal, compliance, or risk-management reasons.

4. Your Content, Characters, Custom Models, and Outputs

4.1 Definitions.
“User Content” means any data, images, videos, prompts, text, training datasets, and other materials you upload, submit, store, or otherwise provide to or through the Service.
“Custom Model” means a model, set of weights, embeddings, LoRA, or other model artifact generated by the Service by training or adapting based on your User Content for your use within the Service.
“Outputs” means any content generated by or through the Service based on your use (for example, images, videos, masks, previews, and generations).

4.2 Your rights. Except for the license you grant us in these Terms and any rights we may have in our underlying technology and base models, you retain whatever ownership and other rights you have in your User Content.

4.3 Our rights (Service and base models). We and our licensors own and retain all rights, title, and interest in and to the Service, including our software, workflows, safety systems, interfaces, and any base/foundation models and underlying technology used to provide the Service (excluding User Content and Outputs to the extent they are owned by you).

4.4 License you grant to us (narrow purpose). You grant us a worldwide, non-exclusive, transferable, sublicensable, royalty-free license to host, store, copy, process, adapt, modify, translate, display, transmit, and otherwise use your User Content solely as reasonably necessary to:

  • provide, operate, maintain, and secure the Service (including running jobs you request);
  • train and serve your Custom Models and generate Outputs for your account;
  • debug, prevent fraud/abuse, enforce these Terms and Policies, and protect the Service and users;
  • provide support you request (for example, investigating job failures);
  • comply with law, legal process, or lawful requests; and
  • enable third-party vendors/subprocessors we engage to support the Service (see Section 3.2).

4.5 No training on your content for our general models. We do not use your User Content, Custom Models, or Outputs to train, fine-tune, or improve any general or foundation models for our own benefit. Your User Content is used to provide the Service to you, including training Custom Models for you and generating Outputs for you, and for the limited purposes in Section 4.4.

4.6 Service improvement (no content training). We may use aggregated and/or de-identified service telemetry and operational data (for example, error rates, performance metrics, infrastructure logs, A/B testing outcomes, and feature usage within our platform) to maintain and improve the Service. This does not include using your private images, prompts, or Outputs to train or improve our general/foundation models.

4.7 Outputs license; clearance responsibility. Subject to your compliance with these Terms and to any third-party rights:

  • we grant you a non-exclusive, worldwide, royalty-free license to use Outputs generated by your account for any lawful purpose; and
  • you acknowledge Outputs may not be unique and may be similar or identical to content generated for others due to the nature of AI systems.

You acknowledge Outputs may inadvertently resemble third-party works, brands, or individuals. You are responsible for evaluating and obtaining any necessary clearances, permissions, or licenses before using Outputs in any public, commercial, or high-visibility context.

4.8 Custom Models access (service-provided). Custom Models are provided as part of the Service and may be hosted by us. Subject to these Terms and your plan limits, we grant you a limited license to access and use your Custom Models within the Service (and, if we explicitly offer export/download, in accordance with that feature’s terms). We do not guarantee that any Custom Model will achieve a particular level of resemblance, accuracy, or performance.

4.9 Your responsibilities regarding User Content, Custom Models, and Outputs. You are solely responsible for:

  • the legality, accuracy, and appropriateness of your User Content and any Outputs you use or publish;
  • obtaining all necessary consents, permissions, and licenses (for example, from people whose images you upload or generate);
  • ensuring your use complies with all applicable laws (including privacy, publicity, copyright, and other IP laws); and
  • maintaining documentation of consents/permissions if requested by us in connection with enforcement or safety reviews.

4.10 User representations and warranties. You represent and warrant that: (a) you own or have all necessary rights to provide your User Content to the Service; (b) you have obtained express, informed consent from any individual depicted in User Content (or whose likeness you attempt to generate), including consent for model training where applicable; (c) your use of any character names, “training tokens,” prompts, or identifiers does not infringe third-party rights (including trademarks); and (d) your use of the Service and Outputs will comply with these Terms, Policies, and applicable law.

4.11 Real persons, likeness, and consent. You must not use the Service to create, upload, or distribute content depicting a real person (including public figures) unless you have that person’s express, informed consent to do so and your use is lawful. This includes, without limitation, deepfakes, impersonations, or synthetic media suggesting real-world actions of a person. You are solely responsible for verifying and documenting such consent.

4.12 Minors and sensitive subjects. You must never use the Service to generate, upload, or share content that depicts minors (real or fictional) in sexualized or otherwise exploitative contexts, or any other content that is abusive, exploitative, or otherwise prohibited by law or our Policies.

4.13 Private by default; public sharing is opt-in only. By default, your User Content, Custom Models, and Outputs are not shared publicly by us. We will not make your creations publicly visible or use them in public-facing marketing without your additional explicit permission (see Section 4.14).

4.14 Showcase / public sharing and marketing permission (opt-in). If the Service offers a feature to mark content as public, showcased, featured, or similar (“Showcase”), you may optionally opt in to publish specific User Content/Custom Models/Outputs. If you opt in, you grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and promote that opted-in content in connection with the Showcase feature and our marketing of the Service (for example, on our website, social media, or ads), subject to applicable law. You may withdraw Showcase permission by changing the content’s visibility settings or contacting us, and we will make reasonable efforts to remove it from our controlled channels; however, copies may persist in backups, logs, or third-party reposts outside our control.

4.15 No expectation of permanent storage. While we may store User Content, Custom Models, and Outputs for your convenience, we do not guarantee that any content will be available or retained indefinitely. It is your responsibility to maintain your own backups of any content you wish to preserve (see Sections 10 and 11).

4.16 Biometric / likeness notice; consent, jurisdiction limits, retention, and sensitive uploads. Some features (including training on face images) may process facial imagery and related features to create a Custom Model that can generate Outputs resembling a person. In some jurisdictions, this may be considered biometric data if used to uniquely identify a person. We do not provide identity verification or authentication services, and we do not use face data to verify who you are.

  • Jurisdiction carve-out. Certain features (including face-training) may be unavailable in some jurisdictions unless we can support required notices, consent flows, or written releases. We may block or restrict these features (for example, in jurisdictions with biometric-specific consent obligations) until compliant flows are implemented.
  • Self-training: By uploading your own face images for training, you represent you have the right to do so and you provide any required explicit consent for such processing in your jurisdiction.
  • Training on others: You must not upload or train on images of other people unless you have their explicit, informed permission for model training and generation, and you agree to provide documentation if requested for safety/enforcement.
  • Consent and written release where required: Where biometric laws require a written release/consent, you agree to obtain and maintain that release and provide it upon request. Separately, where biometric laws impose independent obligations on us as a service provider (for example, retention/destruction policy requirements), we will comply with those obligations and may restrict processing where required.
  • Retention schedule (biometric features). We retain face-related training data and derived Custom Model artifacts until you delete them or delete your account, subject to backups/log retention described in Sections 10.3 and 10.4. Where biometric laws require, we will permanently delete biometric identifiers/information when the initial purpose has been satisfied or within a legally required period, generally no later than three (3) years after your last interaction with the biometric/face-training feature (whichever occurs first), unless longer retention is required by law or needed to establish, exercise, or defend legal claims.
  • Do not upload sensitive content: Do not upload government IDs, financial data, medical information, highly sensitive categories, or content that could expose private or regulated information. Do not upload images of minors for training.

5. Acceptable Use and Prohibited Conduct

You must use the Service in compliance with all applicable laws, rules, and regulations, and in a way that is consistent with these Terms and our Policies. You agree that you will NOT:

  • use the Service for any unlawful, harmful, fraudulent, infringing, defamatory, harassing, hateful, or abusive purpose;
  • upload, train, generate, or distribute content that infringes or misappropriates copyrights, trademarks, trade secrets, privacy, publicity, or other rights;
  • generate or distribute non-consensual intimate imagery, deepfakes, doxxing content, stalking, intimidation, or other content that targets individuals in a harmful or deceptive way;
  • create, upload, generate, or distribute any sexual content / NSFW content, including sexually explicit content, pornography, erotic nudity, fetish content, sexual acts, or sexualized nudity, and any suggestive sexual content involving young-looking persons (even if fictional);
  • create, upload, possess, seek, solicit, attempt to generate, or distribute CSAM (child sexual abuse material) or any content that sexualizes minors, or that we reasonably believe constitutes CSAM or attempted CSAM;
  • attempt to generate content that we prohibit through our safety systems or prompt guards, including sexual exploitation, extreme violence, terrorism, or other abusive content;
  • encourage, promote, or provide instructions for self-harm or suicide, or otherwise facilitate self-harm;
  • promote hatred, harassment, or discrimination targeting protected classes, or create content intended to degrade, intimidate, or threaten;
  • engage in fraud, scams, phishing, social engineering, or deception intended to obtain money, credentials, or sensitive information;
  • generate or distribute imagery or instructions for illegal goods/services (including regulated weapons or prohibited contraband) where unlawful;
  • attempt to bypass, evade, or disable content safeguards, filters, rate limits, quotas, or security features, including instructions to evade filters;
  • impersonate others for deception, fraud, or harm, or create content reasonably likely to mislead others about real-world events or persons;
  • Synthetic media disclosure: where required by law, clearly label or disclose AI-generated or manipulated media, and do not use the Service to create deceptive or misleading deepfakes intended to confuse others about authenticity;
  • interfere with or disrupt the Service or any servers or networks connected to the Service, including by overloading, flooding, spamming, or conducting denial-of-service attacks;
  • attempt to access or use the Service or data (including accounts, characters, Custom Models, or jobs) of other users without authorization;
  • use any automated system (such as bots or scrapers) to access the Service in a manner inconsistent with documented APIs, rate limits, or our instructions;
  • use the Service for high-risk activities where failure or error could lead to death, personal injury, or significant property or environmental damage (for example, medical diagnosis, emergency systems, or critical infrastructure);
  • use the Service in any manner that we reasonably consider abusive, excessive, or intended to cause harm to us, the Service, or others; or
  • use or access the Service in violation of export controls, sanctions, or other applicable trade laws (see Section 20.6).

5.1 Content moderation, monitoring, and enforcement (including human review). We may implement and update automated or manual moderation, safety filters, and prompt guards. These may block, refuse, limit, or modify content or usage that we deem unsafe, prohibited, or otherwise inconsistent with these Terms or our Policies. We have no obligation to monitor content, but we may review, investigate, and take action to enforce these Terms, to improve safety, to provide support you request, and to protect the Service and users. This may include limited human review of prompts, uploads, Outputs, and related logs for abuse investigations, security, fraud prevention, quality assurance, and support troubleshooting.

5.2 Cooperation with authorities; reporting; preservation; enforcement costs. We may preserve relevant records and cooperate with law enforcement, regulators, or other authorities as we determine appropriate or as required by law, including responding to lawful requests and disclosing information when we believe it is necessary to comply with legal obligations or to protect rights, safety, and security. We may also pursue civil remedies for misuse of the Service. We have a zero-tolerance policy for CSAM and attempted CSAM, and we may report suspected CSAM to relevant authorities and hotlines and preserve records as required by law. To the maximum extent permitted by law, you agree to reimburse reasonable costs and fees we incur in investigating, responding to, and enforcing against your material breach of these Terms (including third-party claims and enforcement actions).

5.3 Injunctive relief. You acknowledge that unauthorized access, scraping, abuse, security attacks, infringement, or misuse of the Service may cause irreparable harm. We may seek immediate injunctive or equitable relief (without the necessity of posting a bond, where permitted by law), in addition to any other remedies.

6. Subscriptions, Credits, Billing, and Taxes

6.1 Plans and quotas. We may offer paid subscription tiers (for example, Adventurer, Voyager, Emperor) with different quotas for model trainings, image generations, and video generation seconds. Your access to the Service, including usage limits and performance, depends on the plan you choose and your current quotas.

6.2 Payment processing. Payments are processed by third-party providers (for example, Stripe). By purchasing a subscription or other paid feature, you authorize us and our payment provider to charge your chosen payment method for the applicable fees, taxes, and any other charges you incur in connection with the Service.

6.3 Recurring billing. Subscriptions typically renew automatically at the end of each billing period unless you cancel via the billing portal or other means we provide. You are responsible for timely cancellation before the renewal date if you do not wish to continue.

6.4 No refunds; no credits for partial periods. To the maximum extent permitted by law:

  • All fees, including subscription fees, usage-based fees, and taxes, are non-refundable and non-prorated. You may cancel future renewals at any time, but you will not receive a refund for the current billing period.
  • We do not provide refunds or credits for partial billing periods, unused quotas or credits, downgrades, cancellations, or account closure initiated by you or by us (for example, due to your violation of these Terms).
  • If you dispute any charge, you must notify us promptly and cooperate with us and our payment processor to resolve the issue. Chargebacks that we reasonably consider abusive may result in suspension or termination.
  • Consumer law caveat: Nothing in this section limits non-waivable statutory rights you may have under applicable consumer protection laws (including, where applicable, required withdrawal/refund rights).

6.5 Quotas and overages. Your plan may include quotas (for example, a fixed number of image generations, model trainings, or video seconds per month). When your quotas are exhausted, additional jobs may be blocked, fail with an error, or require you to upgrade your plan. We may change how quotas are calculated and enforced at any time.

6.6 Taxes; exchange rates. Fees are exclusive of any taxes, duties, or similar charges. You are responsible for any such taxes, except for taxes based on our net income. Where required by law, we or our payment processor may collect taxes on your behalf. Exchange rates and payment handling (if paying in a currency other than our pricing currency) may be determined by your bank or payment processor.

6.7 Price and plan changes. We may change our prices, plans, and features from time to time. Unless otherwise stated, changes will take effect at the start of your next billing cycle. If you do not agree to the new prices or terms, you must cancel before they take effect.

6.8 Job execution; failures; credits. Jobs (including training, generation, upscales, and video) may fail, be interrupted, or produce unexpected results due to model behavior, infrastructure issues, third-party provider outages, or other causes. Unless we explicitly state otherwise in the Service, quotas/credits may be consumed when a job is submitted or begins processing, even if the job later fails or the results are unsatisfactory. We may, at our discretion, provide retries or goodwill credit adjustments in some cases, but we do not guarantee retries or credits.

6.9 EU/UK digital services; withdrawal rights; checkout acknowledgement (where applicable). If you are a consumer in the EU/UK, you may have a statutory right to withdraw from certain distance contracts within a cooling-off period (typically 14 days), unless an exception applies (including for digital content/services once performance begins with your express request and acknowledgement, where permitted by law). If we make paid plans available to EU/UK consumers, then where required we will present a clear checkout consent (for example, a checkbox) to capture: (a) your explicit request to begin providing the digital service immediately; and (b) your acknowledgement that your right of withdrawal may be lost or limited once performance begins. If we cannot capture the required acknowledgement, we may (i) delay access to paid features until the withdrawal period ends, (ii) provide a withdrawal/refund where required, or (iii) restrict availability of paid plans in that region until compliant capture is implemented. This does not affect any non-waivable statutory rights you may have.

6.10 Non-payment. We may suspend or terminate access for non-payment, failed charges, or overdue amounts. We do not provide pro-rating unless required by law.

7. APIs and Programmatic Access

7.1 API keys. If we provide API access, you may obtain and use API keys subject to any specific API documentation, rate limits, and restrictions we publish. You must keep your API keys secure and must not share them publicly (for example, in client-side code or public repositories).

7.2 Partners and admins. Certain API features or portals may be limited to partners or admins. We may restrict or revoke access at our discretion.

7.3 Usage limits and throttling. We may impose or modify rate limits and other technical or contractual limits on API usage. Exceeding these limits may result in throttling, errors (for example, HTTP 429 responses), or suspension of access.

7.4 API abuse. We may monitor API usage and may suspend or terminate API access for any behavior that we consider abusive, unsafe, or inconsistent with these Terms or our documentation, without refund.

8. Our Intellectual Property

8.1 Ownership. We and our licensors own all rights, title, and interest in and to the Service and its underlying technology, including but not limited to the software, models, algorithms, infrastructure, design, visual interfaces, trademarks, logos, and any other materials that we provide, excluding User Content and Outputs to the extent they are owned by you.

8.2 License to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your internal, lawful purposes during your subscription or access period.

8.3 Restrictions. You must not:

  • copy, modify, distribute, sell, lease, or create derivative works of the Service or any part of it;
  • reverse engineer, decompile, or attempt to extract the source code, models, datasets, or underlying algorithms (except to the extent such restrictions are prohibited by law);
  • remove, obscure, or alter any proprietary notices; or
  • attempt to use Outputs or any part of the Service to create a competing service or to train or improve models that compete with our services, except as explicitly permitted in writing by us.

9. Privacy and Data Protection

9.1 Privacy Policy. Our collection and use of personal data are described in our Privacy Policy, available at /privacy. You must review and agree to the Privacy Policy as part of using the Service.

9.2 Data you provide. You are responsible for ensuring that any personal data you submit, including images or videos of individuals, is collected, processed, and shared in compliance with applicable privacy laws and with all necessary notices, consents, and permissions.

9.3 Security. We implement reasonable technical and organizational measures to protect the Service. However, no system is perfectly secure. You acknowledge that you provide data at your own risk and must implement appropriate security and backup measures on your side.

9.4 Security incidents. You acknowledge the residual risk of unauthorized access, loss, corruption, interception, or misuse of data. To the maximum extent permitted by law, we disclaim liability for security incidents or unauthorized access outside our reasonable control. Where required by law, we will provide notices of certain security incidents.

9.5 Business users; DPA (where applicable). If you use the Service for business purposes and upload third-party personal data as part of User Content, you are generally the data controller for that third-party personal data, and we act as a processor only to the extent we process User Content to provide the Service. If you need a data processing addendum (DPA), contact [email protected].

10. Data Retention, Inactivity, and Deletion

10.1 Account deletion by you. You can delete your account and associated data at any time using the account settings page. Deleting your account is permanent: your characters, Custom Models, training data, jobs, VideoExpander uploads/jobs, and other data linked to the account will be deleted or de-identified and cannot be recovered, subject to technical and legal limitations (for example, backups and logs). Because the account system is shared, account deletion may affect access to DreamDive, VideoExpander, and ImagineMe.

10.2 Inactivity and data cleanup by us. We may, but are not obligated to:

  • delete or archive User Content, Custom Models, assets, or accounts that have been inactive for an extended period; and
  • perform general storage cleanup and lifecycle management (for example, removal of obsolete assets, previews, or intermediate artifacts) to maintain service performance and control costs.

We are not liable to you for any deletion or loss of data in connection with such cleanup, provided it is consistent with applicable law.

10.3 Backups and logs. Even after account or content deletion, we may retain certain data for a limited period in backups, logs, and systems required for security, billing, fraud prevention, legal compliance, or enforcing these Terms.

10.4 Your responsibility to back up. You are solely responsible for backing up any content or Outputs you wish to retain. We do not guarantee that any content or Outputs will be available at any particular time and do not provide data restoration services for accidentally deleted or lost content.

11. Service Changes, Availability, and Force Majeure

11.1 Changes to the Service. We may add, remove, modify, or discontinue features, functionalities, or components of the Service at any time, including experimental or beta features, job types, models, quotas, interfaces, and the providers/models we use to process jobs. We may change vendors, regions, or model implementations without notice.

11.2 Downtime and interruptions. The Service may be unavailable from time to time due to maintenance, updates, outages, failures of third-party providers, or other causes. We do not guarantee uninterrupted or error-free operation. You acknowledge that downtime and interruptions may occur and that you will not be entitled to refunds, credits, or damages for such events, except as required by law or explicitly provided in a separate written agreement.

11.3 Force majeure. We are not liable for any failure or delay in performance (including downtime, data loss, or failure to deliver Outputs) resulting from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, strikes, government actions, failures of third-party services, or disruptions of internet or network infrastructure.

12. Support, Feedback, and Communications

12.1 Support. We may provide support via our support page (for example, /support) or other channels we make available. Support levels and response times are not guaranteed unless explicitly stated in a separate written agreement.

12.2 Reporting issues. If you encounter any bug, outage, security concern, or other issue with the Service, you agree to promptly notify us and provide sufficient information (for example, reproduction steps, screenshots, and job IDs) to help us investigate and address it. You agree not to exploit any bug or vulnerability for any purpose.

12.3 Feedback. If you provide feedback, suggestions, or ideas (“Feedback”) about the Service, you grant us a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to use, modify, and incorporate such Feedback into our products and services without any obligation to compensate you.

12.4 Communications (service vs product vs marketing). We may send you: (a) service communications (required) such as security alerts, billing notices, and essential account messages; (b) product communications (typically opt-out where lawful) such as feature updates or tips related to your use; and (c) marketing communications such as promotions or campaigns, which are sent only with opt-in where required or under a lawful soft opt-in framework (typically for existing customers and similar products/services). You can opt out of promotional marketing emails using the unsubscribe mechanism we provide (where required by law). Service communications are not optional.

13. Disclaimers

To the maximum extent permitted by applicable law (and subject to Section 14’s carve-outs):

  • The Service and all related content (including Outputs) are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, statutory, or otherwise.
  • We expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
  • We do not warrant that the Service will be uninterrupted, secure, or free of errors, defects, malware, or other harmful components.
  • We do not warrant the accuracy, completeness, legality, or reliability of any Output or information generated by or obtained through the Service. You are solely responsible for evaluating and verifying all Outputs before using them.
  • We do not provide professional advice through the Service (for example, legal, medical, financial, or other professional advice). You must not rely on Outputs as a substitute for professional advice.
  • Safeguards and moderation may fail. We do not guarantee that harmful, unsafe, or policy-violating content will be detected or prevented.

14. Limitation of Liability

Non-excludable liability. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including (where applicable) liability for fraud, intentional misconduct, gross negligence, or for death or personal injury caused by negligence, or any non-waivable consumer statutory rights.

Subject to the above, to the maximum extent permitted by applicable law:

  • In no event will we, our affiliates, or our licensors, suppliers, or partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or in connection with the Service or these Terms, whether based on contract, tort (including negligence), strict liability, or any other theory, even if we have been advised of the possibility of such damages.
  • Without limiting the foregoing, to the maximum extent permitted by law, we are not liable for: (a) unauthorized access, data loss, data corruption, interception, or security incidents; (b) failures or outages of third-party providers; (c) job failures, interruptions, or unsatisfactory results; or (d) harm arising from your use, publication, or reliance on Outputs.
  • Our aggregate total liability arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you actually paid to us for the Service in the three (3) months immediately preceding the event giving rise to the claim; or (b) one hundred (100) U.S. dollars (or equivalent in your local currency).
  • These limitations apply even if any remedy fails of its essential purpose.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those cases, the above exclusions and limitations will apply to you only to the extent permitted by applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, agents, and contractors from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • your use of or access to the Service;
  • your User Content, Custom Models, or Outputs, including any allegation that they infringe, violate, or misappropriation any rights or cause harm to any person or entity;
  • your violation of these Terms, Policies, or any applicable law; or
  • any dispute between you and any third party relating to your use of the Service or Outputs (including disputes about likeness, consent, privacy, or intellectual property).

We reserve the right, at our expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of the claim.

16. Suspension and Termination

16.1 Our rights. We may, in our sole discretion and without liability to you, suspend, limit, or terminate your access to some or all of the Service (including your account, Custom Models, characters, jobs, and Outputs) at any time, with or without notice, if we reasonably believe that:

  • you have violated these Terms, applicable law, or any of our Policies;
  • your use poses a risk to the security, integrity, or availability of the Service or to others;
  • your use is abusive, excessive, or creates an unreasonable load on our infrastructure;
  • we are required to do so by law, a court order, or a request from a government or regulatory authority; or
  • you fail to pay fees when due or initiate chargebacks we reasonably consider abusive.

16.2 No refunds on suspension or termination. If your account or access is suspended or terminated due to your conduct or violation of these Terms, you are not entitled to any refund, credit, or compensation for fees already paid or for any unused quotas or Outputs, except where required by law.

16.3 Termination by you. You may stop using the Service at any time and may delete your account via the account settings page. Termination by you will not relieve you of any obligation to pay any accrued fees or charges.

16.4 Effects of termination. Upon termination, your right to use the Service will immediately cease, and we may delete or restrict access to your User Content, Custom Models, and Outputs, subject to Sections 10 and 11 and any legal obligations we have to retain certain data. We may retain and disclose information to comply with law and to protect the Service and users.

16.5 Content restriction notices and appeals (EEA, where applicable). Where applicable law requires (including for certain EEA users), if we restrict or remove content or suspend/terminate an account, we may provide a statement of reasons and an available appeal or complaint path. This section does not limit our ability to act quickly where necessary for safety, security, or legal compliance.

17. Complaints and Takedown Requests (Copyright, IP, Privacy, Likeness)

17.1 Reporting claims. If you believe content on the Service violates your rights (including copyright, trademark, privacy, publicity, or likeness), you may submit a notice to [email protected] with sufficient information for us to identify the material and evaluate your claim (for example: the URL or job ID, what right is implicated, a description of the issue, and your contact information).

17.2 Copyright notices (DMCA-style, if applicable). For U.S. copyright claims, a DMCA-style notice should include: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the material to be removed (with URL/job ID); (c) your name, address, telephone number, and email; (d) a statement that you have a good-faith belief the use is unauthorized; and (e) a statement under penalty of perjury that the information is accurate and you are the owner or authorized to act, plus your physical or electronic signature.

17.3 Counter-notice. Where applicable, a user may submit a counter-notice with: (a) identification of the removed material and its prior location; (b) a statement under penalty of perjury that the material was removed by mistake or misidentification; (c) the user’s name, address, and signature; and (d) consent to jurisdiction where required by the DMCA process. We may forward notices and counter-notices to the relevant parties as required by law.

17.4 Repeat infringer policy. We may terminate accounts of users who we determine are repeat infringers or who repeatedly violate others’ rights or these Terms.

17.5 Designated contact. Notices may be sent to:
Latysocles Studio, Zegenstraat 42, 3082XV, Rotterdam, The Netherlands
Email: [email protected]

17.6 Notice & action (operational details). To help us process notices efficiently, please include: (a) your name and contact details; (b) the specific content or job ID/URL; (c) the right or policy basis for your request; (d) an explanation of why the content is unlawful or violates rights/policies; and (e) any supporting documentation (where relevant). We may request additional information if needed to evaluate your claim.

17.7 DMCA designated agent (U.S., where applicable). If we have registered a DMCA designated agent with the U.S. Copyright Office, we will post the agent details in this section. If no agent details are listed here, you may send DMCA-style notices to the contact in Section 17.5. This section is provided to streamline U.S.-style notices and does not guarantee that any specific safe harbor applies in every situation.

17.8 EU Digital Services Act (DSA) transparency (where applicable). If the Service is made available to users in the European Union/EEA and applicable DSA obligations apply (for example, where we operate a hosting service or online platform functionality), we may provide legally required information such as statements of reasons for restrictions, complaint handling options, and (where required) transparency reporting. We may update our processes over time.

18. Changes to These Terms and Policies

18.1 Changes to Terms. We may modify these Terms from time to time, for example, to reflect changes in the Service, legal requirements, or business practices. When we make material changes, we will take reasonable steps to notify you (for example, by posting the updated Terms on the Service and updating the “last updated” date, or by sending a notice to your registered email).

18.2 Changes to Policies. We may update the Policies (including safety/content rules) from time to time. Policy updates are effective when posted, unless otherwise stated. Where required by law, we will provide additional notice for material changes. Continued use of the Service after an update takes effect constitutes acceptance of the updated Terms/Policies.

If you do not agree to the updated Terms or Policies, you must stop using the Service and may delete your account.

19. Governing Law and Dispute Resolution

19.1 Governing law. These Terms and any dispute or claim arising out of or in connection with them or the Service will be governed by and construed in accordance with the laws of The Netherlands, without regard to conflict of law principles, except where a different law is required by mandatory local consumer protection or data protection law.

19.2 Dispute resolution. Before initiating formal legal proceedings, you and we agree to first attempt to resolve any dispute informally by contacting each other and cooperating in good faith for at least thirty (30) days.

19.3 Venue. Subject to any mandatory rights you may have under applicable law, you agree that any legal action or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the competent courts of Rotterdam, The Netherlands, and you consent to the personal jurisdiction of such courts.

19.4 Consumer ADR (EU/EEA/UK, where applicable). If you are a consumer in the EU/EEA/UK, you may have the right to use local consumer dispute resolution mechanisms. We encourage you to contact us first at [email protected] so we can try to resolve your issue.

20. Miscellaneous

20.1 Entire agreement. These Terms, together with any Policies explicitly incorporated by reference (including our Privacy Policy and Cookie Policy), constitute the entire agreement between you and us regarding the Service and supersede any prior or contemporaneous agreements, communications, or understandings.

20.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

20.3 No waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

20.4 Assignment. You may not assign or transfer these Terms or any of your rights or obligations hereunder, whether by operation of law or otherwise, without our prior written consent. We may freely assign or transfer these Terms and our rights and obligations without restriction.

20.5 Relationship of the parties. Nothing in these Terms creates any partnership, joint venture, or agency relationship between you and us. You and we are independent contractors.

20.6 Export controls and sanctions. You represent that you are not located in, under the control of, or a national or resident of any country or region subject to comprehensive sanctions, and that you are not on any restricted or denied-party list under applicable export control or sanctions laws. You agree not to use the Service in violation of such laws.

20.7 EU AI Act / synthetic media transparency (future-proof). We may implement labeling, watermarking, metadata, provenance signals, or other measures to comply with emerging laws and standards related to AI-generated or manipulated content (including EU AI Act transparency obligations and similar regimes). You agree not to remove required labels and to make disclosures where required by law.

20.8 Headings. Section headings are for convenience only and have no legal or contractual effect.
